Deed Restrictions Update September 16, 2022

In response to questions from some homeowners regarding Paragraph 26 of the proposed, Amended, Restated and Consolidated Property Restrictions and Reservations (a.k.a Deed Restrictions), the TSHOA Board would like to clarify the following. 

The Board’s proposed role in managing the common area pond would be different from the role the Board proposes with respect to managing shared ponds.  With respect to the common area pond, the Board expects that the HOA’s role could include the allocation of funds (as approved by Members) to help maintain the health and appearance of that pond.  

With respect to shared ponds – ponds around which several homes are built and whose residents share the pond – the Board’s role would be primarily limited to reviewing proposed actions and activities to ensure that one resident’s actions do not unduly affect the other residents’ use and enjoyment of the pond. In other words, the Board’s role would align with one of the basic purposes of Property Restrictions, which is to ensure that residents can use and enjoy their property without interfering with their neighbors’ ability to use and enjoy their property. Any other action the Board may consider pertaining to either shared or common area ponds would only appear in the form of a proposal to the community that conforms both to the guidelines set forth in the Tonkawa Springs Bylaws, and any pertinent state laws concerning water property rights. In any case, these proposed Property Restrictions do not impose (or imply imposing) any new easements on any property owner. Neither do they invite encroachment on any private property, and in fact are written to help prevent such.

The Tonkawa Springs Homeowners Association Board of Directors has had a busy and productive year. It’s hard to believe that it is time to begin planning the slate of candidates for the 2023 Board of Directors. TSHOA Board is made up of 11 positions: President, Vice President, Secretary, Treasurer and seven Directors.

Are you interested in volunteering and making a difference in your neighborhood? Perhaps you have an idea about how to improve upon the beauty of Tonkawa Springs? Maybe you have a talent or skill that you would like to share with your neighbors? Or maybe, you just want to meet some new folks? Pond & Creek Clean-up Days

Pond & Creek Clean-Up Days!

Come help us clean the ponds. Fallen trees, trash and all matter of debris collects in our ponds each year, adding to the layers of muck and mess that are slowly choking the life out of them. We have set aside three dates and invite any and all residents to grab a rake and come help clean the shores of the “main” pond adjacent to our neighborhood park first, and then to other ponds up and down “Beaver Creek” as time and home-owners permit.

We will take care to perform pond clean-up only on those properties whose owners have given us specific permission to do so. In fact, we would love it if said pond owners could also come lend a hand to the effort, or at least let the organizers know of any restrictions or special considerations. In addition, we will require all participants to sign an agreement holding both the TSHOA and individual property owners harmless should any mishap occur in the act of clean up.

Meet at Tony Garrant’s place at 3204 Quarry Creek to receive instructions and placement. Please bring gloves, grungy clothes, rakes, saws and any other tools you think might be helpful in clearing debris. We will provide bags and arrange for disposal of debris.

Tonkawa Springs Homeowners,


We’re excited to share with you a revised set of deed restrictions for your vote.

This posting includes the updated deed restrictions (DRs) representing feedback from the Community and a summary of actions taken to preserve that feedback.


Our primary objectives for updating the deed restrictions are:

● Update language to reflect the new state regulations under Senate Bill 1588 (SB1588).
● Consolidate four sets of DRs into a single set to be more easily managed by future volunteer
Boards.
● Added language to reflect changes to the role of the Architectural Control Committee (ACC)
made in SB1588.

Once you have reviewed these documents, please vote either by:

Two (2) votes may be submitted for each Lot owned within TSHOA. The ballots should be completed and signed in the spaces indicated.

Place your completed ballot in a sealed envelope and drop it in the voting box at 3201 Fox Hollow prior to 7:00pm CST on Sunday, October 2, 2022

Central Texas Refuse, Tonkowa Springs HOA’s contractor for solid waste removal, will collect household bulk items and bundled brush placed at the curb on Saturday September 10th, 2022.

We received a call from the tennis court vendor regarding the repairs scheduled for today Tuesday July 26th. That service has been pushed to Thursday July 28th due to material delays.After the cracks are filled, the courts will be useable. They do suggest owners wait until Saturday to use the tennis courts.
